The main regulations that apply to Installers are Royal Decree 110/2015 and Royal Decree 27/2021 on WEEE, Law 07/2022 on waste and contaminated soils, Royal Decree 553/2020 regulating waste transportation, and Royal Decree 115/2017 on fluorinated gases.
The main obstacle to proper waste management is therefore the abundance and complexity of the regulations, which sometimes leads to confusion and uncertainty.
+ Registration as waste producer in the Register of Producers of the corresponding Autonomous Community.
+ Obtaining of the Environmental Identification Number (NIMA).
+ Specific professional certification for the management of fluorinated gases and domestic air conditioning systems.
+ Professional installation or de-installation of equipment, in accordance with the technical procedures of good professional practice and avoiding atmospheric emissions.
+ Proper management of waste, whether through agreements with authorised managers (processing contract) or an Extended Producer Responsibility Collective System (EPRCS) like Fundación ECOTIC, or returning the old device to the distributor’s facilities.
+ Awareness of the final destination of the waste, with the aim of improving its traceability.
Installers who do not comply with current regulations may be subject to fines or other sanctions such as temporary occupational disqualification or the closure of their premises.
Financial penalties for failure to meet these responsibilities can be as high as 1,750,000 euros.
